How can I get this drunk driver to pay for all the damages?

A drunk driver with a suspended DUI license rear ended my car and totaled my Jaguar. I came out with a concussion and aggravated a ruptured disk that I already had. I had lots of bruises on my legs and ankles. Now my doctor says I may have to have surgery on my back.

You can file a claim, and if need be, a lawsuit against the at-fault driver. If they don't have adequate insurance, you may be able to make a claim against your auto insurance policy in the uninsured or underinsured motorist coverage.

You can sue the driver who hit you. If that driver has inadequate or no insurance, which is likely, you can make a claim against your own uninsured or underinsured motorist coverage. In addition, you may be able to bring a claim against the bar which served the drunk the alcohol which got him drunk. Finally, if the guy who hit you was prosecuted, you may be able to get compensation from the Oregon Victims' Compensation Fund. But it sounds like you will need the assistance of a good lawyer.
