How can I obtain recorded statements from a car insurance company?

I am suing someone for damage to my car from a car accident that they caused . I would like to know how I go about obtaining the recorded statements from car insurance company, that the person I am suing gave and that I gave as well.

You can probably get your statement from the insurance company. However, you probably can't get the statement of the other driver from that driver's insurer.

You have a right to the statement that you gave the insurance company. If you have already filed a lawsuit you should file a request for production (a formal pleading) with the attorney for the insurance company and he or she will provide it to you. If you have not filed a lawsuit, you can just send the adjuster a letter requesting the statement. If the insurance company took a statement from their insured you do not have a right to this statement in most cases as it is considered "work product." Any investigative materials the other side produces in anticipation of litigation is arguably work product. You will have to obtain your own statement from the other driver through formal depositions.
